Privacy Policy

I. Abbreviations and Definitions

Definitions:

1. GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – OJ L 119, 4.5.2016, p. 1.
2. Joint Controllers - The entities specified in Section II, Clause 1 of this Privacy Policy, who jointly determine the purposes and means of processing personal data, hereinafter also referred to as "RIO Apartments".
3. Client - A data subject whose personal data is processed on any basis specified in Article 6 of the GDPR.
4. Cookies - Text files saved by the browser on a computer or mobile device.
5. Profiling - Any form of automated compilation of information about a person in order to make decisions about them or to analyze or predict their preferences, behaviors, and attitudes.

II. General Provisions

1. The following entities are the Joint Controllers of personal data:
   1. RIO Apartamenty property managed by Rio24 Sp. z o.o., ul. Świeradowska 51-57, 50-559 Wrocław, Tax ID: 8983030245
2. Under the joint controllership agreement, the Joint Controllers have established the scope of their responsibilities regarding the fulfillment of obligations arising from the GDPR. In particular, they have agreed to the following:
   a) The Joint Controllers are jointly responsible for fulfilling the information obligation towards Clients;
   b) The Joint Controllers are jointly responsible for enabling Clients to exercise their rights arising from the GDPR.
   In light of the above agreements, you can exercise your rights with either of the Joint Controllers.
3. Rio24 Sp. z o.o. respects the right to privacy and ensures data security. To this end, it provides a level of security commensurate with the risk of violating the rights and freedoms of natural persons due to personal data processing.

IV. Purposes and Legal Bases of Processing

1. Personal data will be processed for 30 days for the following purposes:
   1) Taking action before entering into a contract, at the request of the data subject, or for the performance of a contract for accommodation services to which the data subject is a party (the data necessary for concluding the contract is specified in the reservation and accommodation services sales form) - based on Article 6(1)(b) of the GDPR;
   2) Fulfilling a legal obligation incumbent on the Joint Controllers (e.g., tax obligations) - based on Article 6(1)(c) of the GDPR;
   3) Realizing the legitimate interests of the Joint Controllers (e.g., pursuing or securing claims, ensuring the safety and protection of people and property, performing a contract concluded with a third party on behalf of the Client) - based on Article 6(1)(f) of the GDPR.
2. The provision of personal data is voluntary, but for the data necessary for the provision of accommodation services, it is required for the conclusion and performance of the contract.
3. Monitoring in common areas of the properties is installed to ensure the safety of Clients and the protection of property.

V. Categories of Data Processed

We process the following categories of Clients' personal data:
Name and surname;
Residential address;
Email address;
Phone number;
Payment card details (in case of card payments);
Information about the date of stay;
Information about stay preferences;
Number of adults included in the order;
Number and age of children included in the order;
Data necessary for issuing a VAT invoice;
Language for contact;

VI. Data Recipients

We may share personal data with the following recipients:
LEMONPIXEL.PL Roman Korczyński, ul. Młyńska 12A, 58-570 Jelenia Góra, which operates the reservation module on our website;
Other companies (including IT companies) with whom we cooperate in managing the services provided.

VII. Transfer of Data to Third Countries or International Organizations

We inform you that we do not transfer personal data outside the European Economic Area, except in cases where the Client makes such an explicit request.

VIII. Data Retention Period

1. Personal data processed for the purpose of concluding and performing a contract, as well as fulfilling a legal obligation and realizing the legitimate interests of any of the Joint Controllers, will be stored for the duration of the contract and thereafter for the period necessary to:
   a) Secure or pursue potential claims;
   b) Fulfill a legal obligation of any of the Joint Controllers (e.g., arising from tax regulations).
2. Personal data processed based on separate, voluntary consent will be stored until the consent is withdrawn, an objection to its processing is raised, or until it is no longer necessary for the fulfillment of the aforementioned purpose. After this period, it will be stored until the expiration of any potential claims.
3. Personal data in the form of images from monitoring recordings are stored for up to 30 days, after which they are permanently deleted by overwriting.
4. Detailed information on the scope and purpose of personal data processing, the type of personal data, and their retention period are included in Annex 1 to the Privacy Policy.

IX. Your Rights

You have the right to:
a) Access your data and receive a copy of it;
b) Rectify (correct) your data;
c) Erase data;
d) Restrict data processing;
e) Object to the processing of your data;
f) Data portability;
g) Lodge a complaint with a supervisory authority;
h) Withdraw your consent to the processing of your personal data at any time if your data is processed based on your expressed consent – the withdrawal of consent will not affect the lawfulness of processing based on your consent before its withdrawal.

X. Information on the Requirement/Voluntariness of Providing Data

Providing data is a condition for concluding a contract and/or providing a service. If the data is not provided, we may refuse to conclude a contract and/or provide a service.

XI. Information on the Source of Data

If you have not provided your personal data personally, we have obtained the data from an entity that has concluded a contract with any of the Joint Controllers for the provision of hotel services on behalf of the Client or from an entity with which the Client has concluded a contract for the reservation of services provided by the Joint Controllers.

XII. Copyrights

1. All content and information on our website are the property of Rio24 Sp. z o.o. and are protected in accordance with the Act of February 4, 1994, on Copyright and Related Rights (Journal of Laws of 2017, item 880, as amended), in particular regarding their use, display, copying, transfer, dissemination, modification, or deletion.
2. Any actions within the scope specified in point 1 above require the written consent of Rio24 Sp. z o.o. Otherwise, they will be considered unlawful and will constitute a violation of the company's intellectual property.

XIII. Cookies

1. The website uses cookies for statistical purposes and to personalize service settings.
2. The Client can manage cookies within their web browser.
3. Disabling cookies may cause difficulties in the proper functioning of the service.

XIV. Final Provisions

1. The Joint Controllers reserve the right to change the Privacy Policy.
2. The Client is bound by the current Privacy Policy posted on the website www.rioapartamenty.pl at the time of concluding the service agreement.

INFORMATION FOR GUESTS MAKING A RESERVATION

1. Hotel check-in starts at 3:00 PM and check-out is at 10:00 AM.
2. The price per night stated in the reservation confirmation is the cost of renting the apartment for one night.
3. Possible forms of payment for reservations, depending on the type of offer selected, are: cash/credit card at the property, traditional bank transfer, or online bank transfer.
4. A guaranteed reservation is possible. To guarantee your stay, you must make a payment immediately after making the reservation using the available payment methods. The amount of the payment is 100%.
5. In case of cancellation or shortening of the stay without observing the deadlines specified above, as well as in case of a no-show, the property reserves the right to charge you for the reservation costs.
6. The basis for calculating the PLN equivalent for reservations with EUR rates is the fixed foreign exchange rate multiplied by the average EUR exchange rate according to the valid NBP exchange rate table from the day preceding the day of arrival.
7. In accordance with Article 38(12) of the Act of May 30, 2014 (Journal of Laws 2014, item 827), the Client is not entitled to withdraw from the contract.
8. The procedure for submitting and considering complaints directed to Rio24 Sp. z o.o. by individual clients (consumers) is located below this reservation confirmation.

COMPLAINT PROCEDURE FOR INDIVIDUAL CLIENTS (CONSUMERS)

1. Rio24 Sp. z o.o., ul. Świeradowska 51-57, 50-559 Wrocław, Tax ID: 8983030245 considers complaints submitted by Clients in the manner and within the deadlines specified in this Procedure, unless the legal relationship (e.g., contract) between the Client and Rio24 Sp. z o.o. provides otherwise.
2. For the purposes of this procedure, a "Client" is a consumer as defined by the Act of April 23, 1964, civil code (Journal of Laws 2014, item 121) using the services provided by Rio24 Sp. z o.o. and submitting a Complaint.
3. For the purposes of this procedure, a "Complaint" is considered a statement of the Client made in writing or sent by email (regardless of the name/title of the document) addressed to Rio24 Sp. z o.o., which concerns a violation of the Client's rights arising from the use of services offered by Rio24 Sp. z o.o. The Complaint should contain data that allows for the unambiguous identification of the Client, as well as contact details and the subject of the Complaint (a detailed description of the Client's reservations).
4. Complaints in written form should be sent to the address: Rio24 Sp. z o.o., ul. Świeradowska 51-57, 50-559 Wrocław. Complaints in electronic form should be sent to the email address: kontakt@rioapartamenty.pl.
5. The Client should submit the Complaint as soon as possible after becoming aware of the circumstances giving rise to reservations, in order to ensure a fair and effective consideration of the Complaint.
6. Upon receipt of a Complaint, Rio24 Sp. z o.o. will take steps to consider it. An authorized employee has the right to contact the Client in cases requiring factual verification with the Client's participation or to obtain additional information necessary for the proper consideration of the Complaint.
7. Complaints are handled in writing (or via email in response to a Complaint sent in that manner).
8. The response to the Complaint will contain: a) factual and legal justification, unless the nature of the objections raised does not require it; b) information about the reported problem, with reference to relevant parts of the contract or regulations applicable at the property, unless the nature of the objections raised does not require it; c) the name of the person providing the response.
9. The response to a Complaint submitted by the Client should be provided as soon as possible, but no later than 14 days from the date the Complaint is received.
10. The decision to pay compensation to the Client or to make a refund must always be approved by the Management Board.
